The Access Parties filed this lawsuit against Omaha Steak alleging that Omaha Steak’s website, www.omahasteaks.com, contains barriers that prevent full and equal use by persons with a visual impairment. To facilitate the accessibility and usability of its website, Omaha Steaks is implementing the relevant portions of the World Wide Web Consortium’s Web Content Accessibility Guidelines 2.0 Level AA as its web accessibility standard. This will also bring the website and other consumer facing properties into further conformance with the Web Accessibility Standards developed by the United States Access Board. The website will be tested on a periodic basis with assistive technology such as screen readers and screen magnifiers, and with users with disabilities who use these technologies. Omaha Steaks has adopted a website accessibility policy to support its commitment to the accessibility of its website. This policy includes a method for users to voice concerns regarding accessibility of the site.
Hickory Farms Press Release and Litigation Summary
The Access Parties filed this lawsuit against Hickory Farms, LLC alleging that Hickory Farms’ website, www.hickoryfarms.com contains barriers to full and equal use of the website by persons with visual impairments and is therefore in violation of Title III of the ADA. To ensure the accessibility and usability of the website Hickory Farms, LLC will engage an accessibility consultant to assess the website and provide recommendations on how to facilitate compliance with the Web Content Accessibility Guidelines 2.0 Level A and AA Success Criteria (“WCAG 2.0 AA”).
KSL Resorts Press Release and Litigation Summary
The Access Parties filed this law suit against KSL II Management Operations, LLC, hereinafter referred to as KSL Resorts, alleging that KSL Resort’s websites contain barriers that prevent full and equal access by people with disabilities. To ensure accessibility and usability of their websites, KSL Resorts will use reasonable efforts to provide persons with a disability (as defined under the ADA), including the Plaintiff, an equal opportunity to participate in or benefit from the goods, services, privileges, advantages, and accommodations provided through its Websites. The Defendant will make changes to their websites to ensure compliance with the World Wide Web Consortium’s Web Content Accessibility Guidelines 2.0 Level AA. The website will be tested on a periodic basis with assistive technologies such as screen readers and screen magnifiers. The defendant will engage a qualified accessibility consultant to assess the Websites so they conform to WCAG 2.0 AA.
Rally House Stores Press Release and Litigation Summary
The Access Parties filed this lawsuit against Rally House Stores, Inc. alleging that the Defendant’s website, www.rallyhouse.com, contains barriers that prevent full and equal use by persons with a visual impairment. This is in violation of Title III of the ADA. To facilitate the accessibility and usability of its website, Rally House Stores, Inc. is implementing the relevant portions of the World Wide Web Consortium’s Web Content Accessibility Guidelines 2.0 Level AA as its web accessibility standard. The website will be tested with assistive technologies such as screen readers and screen magnifiers on a regular basis and engage a web accessibility consultant to provide recommendations to facilitate website accessibility and conformance with WCAG 2.0 AA. The Defendant will post on the website a web accessibility policy with an accessible form or email to submit feedback.
Powdr Corporation Press Release and Litigation Summary
The Access Parties filed this lawsuit against Powdr Corp. alleging that the defendant’s websites contain barriers that prevent full and equal use by persons with a visual impairment. To facilitate accessibility and usability Powdr Corp will implement relevant provisions of the World Wide Web Consortium’s Web Content Accessibility Guidelines 2.0 level AA as its web accessibility standard.
Snow Time Inc. Press Release and Litigation Summary
The Access Parties Filed this lawsuit against Snow Time, Inc. alleging that the defendant’s websites contain barriers that prevent full and equal use by blind persons. To facilitate accessibility and usability of its websites Snow Time, Inc. is implementing relevant portions of World Wide Web Consortium’s Web Content Accessibility Guidelines 2.0 Level AA to ensure usability by blind persons. The Defendant will employ a web accessibility coordinator. Snow Time, Inc. will adopt a Web Accessibility Policy. This policy will be shared with all web content personnel, contractors responsible for web content, and Client Service Operations call center agents (“CSO Personnel”) for the Website. An accessible way to provide feedback will be provided with the Web Accessibility Policy. Defendant shall train no fewer than three of its CSO Personnel to automatically escalate calls from customers with disabilities who encounter difficulties using the Website. Defendant shall modify existing bug fix policies to comply with WCAG 2.0 AA. The Defendant will employ a web accessibility consultant.
